Part One — What You Need to Know
These terms govern your use of the Tiora platform. They apply to everyone with access to a Tiora archive, regardless of your role. By accessing the platform you agree to be bound by them.
Who these terms apply to
These terms apply to all platform users including Founders, Co-Custodians, Active Members and View-Only Members. Your level of access is determined by the Founder of the archive you belong to, not by Tiora.
Your account
You are responsible for keeping your login credentials secure. You must provide accurate information when creating or verifying your account. You may not share your account with anyone else or allow others to access the platform using your credentials.
What you can do on the platform
The platform is for personal family archive use only. You may view, organise and manage content within the permissions assigned to your role. You may not use the platform for any commercial purpose, to store content belonging to third parties without their consent, or in any way that violates Australian law.
Content and intellectual property
You own the content you upload. Tiora owns the platform, its design, its software and its underlying systems. You may not copy, reverse engineer or reproduce any part of the platform.
Service availability
Tiora aims to keep the platform available at all times but does not guarantee uninterrupted access. Maintenance, updates and circumstances outside our control may affect availability. We will provide notice of planned downtime where possible.
Termination
Tiora may suspend or terminate access where these terms have been breached. Founders may remove access for any user on their archive at any time. If your access is terminated by Tiora you will be notified and given an opportunity to export any content you own.
Third party services
The platform may connect to third party services including payment processors and storage infrastructure. Tiora is not responsible for the conduct or availability of third party services. Your use of those services is subject to their own terms.
Changes to these terms
Tiora may update these terms with 30 days written notice. Continued use of the platform after that period constitutes acceptance. If changes materially affect your rights you may close your account before they take effect.
1. Definitions
- Platform means the Tiora web application and all associated services.
- User means any individual with access to the platform in any role.
- Founder means the individual who holds primary authority over an archive and entered a Founding Member Agreement or equivalent commercial agreement with Tiora.
- Co-Custodian means a User appointed by the Founder to share archive authority.
- Active Member means a User granted access to view and interact with archive content as defined by the Founder.
- View-Only Member means a User granted read-only access to archive content as defined by the Founder.
- Content means all photographs, documents, metadata, notes and other materials uploaded to or created within the platform.
- Archive means the structured digital collection associated with a family account.
2. Acceptance of terms
- By accessing the platform you agree to these terms.
- If you are accessing the platform as an invited User rather than as a Founder, these terms still apply to your use. The Founder is responsible for ensuring invited Users are made aware of these terms.
- Users must be 18 years or older to hold an account. Founders are responsible for any access granted to minors within their archive.
3. Account creation and verification
- To access the platform you must create an account using accurate and complete information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify Tiora immediately if you become aware of unauthorised access to your account.
- Tiora may require identity verification before granting or restoring access to certain account functions, including Co-Custodian appointment and succession activation.
- You may not create accounts under false identities or impersonate another person.
- Tiora reserves the right to verify account information and to suspend accounts where information cannot be verified.
4. Acceptable use
- The platform is for personal family archive use only.
- You must not use the platform to store, share or distribute content that is unlawful, defamatory, obscene or in breach of any third party rights.
- You must not use the platform for any commercial purpose without Tiora's written consent.
- You must not attempt to gain unauthorised access to any part of the platform or to any other User's account or archive.
- You must not use automated tools, scripts or bots to interact with the platform without Tiora's written consent.
- You must not upload content that contains malware, viruses or any code designed to disrupt or damage the platform or its users.
- Tiora reserves the right to remove content that breaches these terms without notice.
5. Content and intellectual property
- You retain ownership of all content you upload to the platform.
- By uploading content you grant Tiora a limited, non-exclusive, non-transferable licence to store, process and display that content solely for the purpose of delivering the platform services to you.
- Tiora owns all intellectual property in the platform including its software, design, structure, processes and documentation. Nothing in these terms transfers any of that intellectual property to you.
- You must not copy, reproduce, modify, reverse engineer or create derivative works from any part of the platform without Tiora's written consent.
- If you provide feedback or suggestions about the platform, Tiora may use that feedback without restriction or compensation.
6. Privacy and personal information
- Tiora collects, stores and processes personal information in accordance with the Privacy Act 1988 (Cth) and the Tiora Privacy Policy.
- The Privacy Policy explains what information is collected, how it is used, how it is stored and how you may access or correct your information.
- By using the platform you consent to the collection and handling of personal information as described in the Privacy Policy.
- Where personal information is stored or processed outside Australia, Tiora will take reasonable steps to ensure equivalent privacy protections apply.
7. Service availability and downtime
- Tiora will use reasonable efforts to keep the platform available at all times.
- Tiora does not guarantee uninterrupted or error-free access. The platform may be unavailable due to maintenance, updates, third party infrastructure issues or circumstances outside Tiora's reasonable control.
- Tiora will provide reasonable advance notice of planned maintenance where possible.
- Tiora is not liable for losses arising from platform unavailability except where unavailability results from Tiora's negligence or wilful misconduct.
8. Termination and suspension
- Tiora may suspend or terminate your access to the platform where you have materially breached these terms, where continued access poses a risk to other users or to the platform, or where required by law.
- Where practicable, Tiora will provide notice before suspending or terminating access and will give you an opportunity to respond.
- On termination of your account by Tiora, you will be offered an export of any content you own before access is removed.
- A Founder may remove access for any User on their archive at any time without notice to Tiora.
- Termination does not affect any rights or obligations that have already arisen under these terms.
9. Third party integrations
- The platform may integrate with or connect to third party services including payment processors, storage infrastructure providers and communication tools.
- Tiora is not responsible for the availability, conduct or content of third party services.
- Your use of third party services connected to the platform is subject to those services' own terms and privacy policies.
- Tiora will take reasonable steps to ensure that third party service providers who handle your data are subject to appropriate confidentiality and security obligations.
10. Liability
- Tiora will take reasonable care in delivering the platform service.
- Tiora is not liable for indirect or consequential losses or losses arising from circumstances outside its reasonable control.
- To the maximum extent permitted by law, Tiora's liability for breach of any consumer guarantee under the Australian Consumer Law is limited to either the resupply of the services or the payment of the cost of having the services supplied again.
- Subject to the above, Tiora's total liability in any twelve month period is limited to the fees paid by you in that period.
- Nothing in these terms excludes or limits liability that cannot be excluded under Australian law. Your rights under Australian Consumer Law remain unaffected.
11. General
- These terms are governed by the laws of New South Wales, Australia.
- Disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
- Tiora may update these terms with 30 days written notice. Continued use of the platform after that period constitutes acceptance. If changes materially affect your rights you may close your account before they take effect.
- If any provision is found unenforceable the remaining provisions continue in full force.
- These terms constitute the entire agreement between Tiora and Users with respect to use of the platform. Founding Members are also subject to their Founding Member Agreement, which prevails in the event of any conflict.
